By using the SoldOutRooms.com website, you agree to the following terms and conditions (the "Terms & Conditions") and, therefore, agree to be legally bound just as if you had signed this Agreement. If you do not agree to these Terms & Conditions, please do not use the site and/or register to become a member.
Payments and Requirements
- All hotel contracts require a minimum night stay.
- Hotels are pre-paid by Wharf Travel Services, Inc. t/a SoldOutRooms.com.
- The total price paid upon at completion of order and check out includes all hotel taxes and administrative fees. Full payment to Wharf Travel Services, Inc. t/a SoldOutRooms.com is required to guarantee your reservations.
- Wharf Travel Services, Inc. t/a SoldOutRooms.com is not liable for any incidental charges you may incur during your stay. All incidental charges must be paid directly to the hotel upon check out.
- Prices listed on SoldOutRooms.com include an administrative fee. The fee reflects the degree of difficulty, and, of course the cost of obtaining rooms at properties for sold out events.
- Forms of payment accepted include Visa, MasterCard, American Express and Discover Card. Credit card statements will reflect payment to Wharf Travel Services, Inc.
- Reservations are made in the cardholder's name. To add to or change the reservation name, a fax copy of the cardholder's driver's license and front and back copy of the credit card must be submitted along with the name change request.
Cancellation and Refunds
- All reservations are prepaid and non-refundable. (Optional Trip Protection & Cancellation Insurance is available)
- No refunds or credits will be given for any reason including but not limited to the following: unused hotel reservations; unused portion of hotel reservation; reduction in group size; and reservations canceled due to failure of purchaser to comply with the terms and conditions listed herein.
- In the event of cancellation or postponement of a certain event, Wharf Travel Services, Inc. t/a SoldOutRooms.com will not be responsible for accommodations before or beyond the scheduled date of the certain event. Wharf Travel Services, Inc. will provide refunds only to the extent that refunds are available to Wharf Travel Services, Inc.
- Wharf Travel Services, Inc. t/a SoldOutRooms.com reserves the right to substitute hotels of equal or higher status.
- Wharf Travel Services, Inc. t/a SoldOutRooms.com reserves the right to cancel, at its sole option, any reservation. If Wharf Travel Services, Inc. t/a SoldOutRooms.com cancels reservations without cause attributable to purchaser, a full refund will be remitted to the canceled party.
Indemnification
You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities which occur under your account. You agree to indemnify, defend and hold harmless Wharf Travel Services, Inc. t/a SoldOutRooms.com and its officers, directors, employees, consultants, volunteers, staff and agents from any and all third party claims, liability, damange and/or costs (including, but not limited to, attorneys fees) arising from your use of the SoldOutRooms.com website, your violation of the terms of use or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. You agree to immediately notify Wharf Travel Services, Inc. t/a SoldOutRooms.com of any unauthorized use of your account or any other breach of security known to you.
Termination and Modification
You agree that Wharf Travel Services, Inc. t/a SoldOutRooms.com, in its sole discretion, may terminate your password, account or use of the SoldOutRooms.com website for any or no reason. You agree that any termination of your access to the SoldOutRooms.com website under any provision of this Terms & Conditions may be effected without prior notice. Wharf Travel Services, Inc. t/a SoldOutRooms.com reserves the right, at our discretion, to change, modify, add, or remove portions of these Terms & Conditions at any time. Please check these terms periodically for changes.
Disclaimer
Purchaser acknowledges that Wharf Travel Services, Inc. t/a SoldOutRooms.com is acting as an independent intermediary for suppliers of goods and services, which are not directly supplied by this company, such as hotel accommodations, and shall not be responsible for actions or omissions on the part of such suppliers, which result in any loss, damage, delays, or injury to you or your travel companions or group members. Wharf Travel Services, Inc. t/a SoldOutRooms.com shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, war, insurrection, social or labor unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments or any other actions, omissions or conditions outside the company’s control. By embarking upon his/ her travel, the traveler(s) voluntarily assumes all risks, and is advised to obtain appropriate insurance coverage against them. Your completed reservation shall constitute consent to the above and an agreement on your part to convey the contents here to your travel companions of group members. The purchaser, by engaging the company, acknowledges these conditions and agrees to hold the company blameless in making the arrangements on his behalf, and agrees that restitution or damages, if any are claimed, shall be sought directly from the suppliers.
